What Are Robbery Charges?

Robbery is theft accomplished by force or fear. That single element separates it from ordinary theft and is why the bail is an order of magnitude higher.

Penal Code §211 — Robbery Defined

Penal Code §211 defines robbery as taking property from another's person or immediate presence, against their will, by force or fear. There is no misdemeanor version of this charge.

Penal Code §212.5 — Degrees

Penal Code §212.5 makes robbery first degree in an inhabited dwelling, against a for-hire driver or passenger, or at an ATM. Second degree covers everything else and carries lower bail.

Penal Code §213 — Punishment

Penal Code §213 sets the prison exposure by degree. That sentencing range is what drives the county bail schedule and, in turn, the size of the premium your family finances.

Enhancements — Firearms & Strikes

A firearm allegation under Penal Code §12022.53 or a prior strike under Penal Code §667 can multiply the scheduled bail and moves the file to our highest tier.

What a Robbery Bail Bond Costs

The bail premium in California is 10% of the total bail, fixed by Cal. Ins. Code §1800. Robbery bail is high, so the structure of the down payment matters more here than on any other charge. The table below shows a 1% down structure at typical robbery bail amounts.

Total BailStandard 10% Premium1% DownRemaining Financed Balance
$50,000$5,000$500$4,500
$100,000$10,000$1,000$9,000
$250,000$25,000$2,500$22,500
$500,000$50,000$5,000$45,000
$1,000,000$100,000$10,000$90,000

1% down is a qualification-based tier and is uncommon on robbery filings. The full 10% premium set by California law is still owed and is financed on a signed payment plan. Most robbery bonds write at 5% or 10% with collateral because robbery is a strike offense.

Down Payment Tiers

Four tiers, assigned honestly based on the cosigner's profile and the counts filed. You'll know your tier before any paperwork moves.

Who Qualifies

Strong-credit cosigner (700+), stable long-term employment, homeowner or verifiable equity, and a signed financing agreement for the remaining 9%.

3%
3% Down

Who Qualifies

Fair-to-good credit cosigner (640+), steady employment 12+ months, and clean prior FTA history.

5%
5% Down

Who Qualifies

Cosigner with limited credit history but strong income, or defendant with local ties and steady employment.

Notes

The most common robbery tier, typically paired with collateral on six-figure bail.

10%
10% Down (Full Premium Up Front)

Who Qualifies

No cosigner available, no credit, or a high-risk profile (prior FTA, out-of-state defendant, very high bail-to-income ratio).

Notes

Standard where a firearm enhancement, a strike prior, or bail above $500,000 is involved.

Who Qualifies (and Who Doesn't)

Straight talk on what gets a robbery bond approved at our lowest tier — and what moves it up.

What Helps You Qualify

  • Second-degree robbery filing with no weapon and no injury alleged.
  • Homeowner cosigner or verifiable real property equity.
  • Cosigner with strong credit and long-term stable employment.
  • Defendant with deep local ties — family, job, California address.
  • No prior strike convictions and no prior FTA.

What Moves You Up a Tier

  • First-degree robbery under §212.5.
  • Firearm or great bodily injury enhancement alleged.
  • Prior strike conviction on record.
  • Multiple counts, co-defendants, or an alleged robbery series.
  • Out-of-state defendant or prior bond forfeiture.
Important

Robbery bail is high, but families post these bonds every week. What matters is the cosigner package and the collateral. Call us and we'll tell you exactly what we need before you drive anywhere.

Cases Approved for 1% Down

These are the robbery profiles most likely to reach our lower financing tiers — second degree, no weapon, strong cosigner.

Second-Degree Robbery, No Weapon

Force-or-fear allegations without a weapon carry the lowest robbery bail on the schedule.

  • No firearm or deadly weapon alleged
  • No great bodily injury
  • Bail commonly $50,000–$100,000

No Injury to the Victim

Where no one was hurt, both the schedule and our underwriting come down meaningfully.

  • No GBI enhancement
  • No medical treatment alleged
  • Property recovered in many cases

First-Time Defendant

No criminal history is the single strongest factor on a strike-offense file.

  • No prior convictions
  • No strike priors
  • Not on probation or parole

Homeowner Cosigner With Collateral

Real property equity is what makes a six-figure robbery bond writable at a lower tier.

  • Verifiable equity in California property
  • Strong credit profile
  • Clean prior FTA history

Strong Local Ties

A defendant rooted in the county is a lower flight risk and a lower forfeiture risk.

  • Long-term California residence
  • Steady local employment
  • Family in the county

Cases at a Higher Tier

These robbery filings carry the highest bail and forfeiture exposure, and they write at a 5% or 10% structure with collateral.

First-Degree Robbery

Robbery in an inhabited dwelling, of a for-hire driver, or at an ATM carries the highest robbery bail.

  • Inhabited dwelling or ATM allegation
  • Strike offense
  • Bail commonly $100,000+

Armed Robbery / Firearm Enhancement

A firearm allegation adds years of exposure and multiplies the scheduled bail.

  • Firearm used or displayed
  • Enhancement pleaded in the complaint
  • Bail often $500,000+

Great Bodily Injury Alleged

Injury to the victim converts the file into a violent-felony posture with elevated bail.

  • Victim injured during the taking
  • GBI enhancement alleged
  • Higher forfeiture risk

Strike Priors or Robbery Series

Prior strikes or a pattern of alleged robberies push the file to our highest tier.

  • Prior serious or violent felony
  • Multiple incidents alleged
  • Second- or third-strike exposure

No Cosigner or No Collateral

An underwriting policy, not a criminal statute. Six-figure robbery bail cannot be financed without security or a qualified cosigner.

  • No real property or vehicle collateral
  • No verifiable income
  • Out-of-state defendant

Insurance Code §1800 governs the premium itself; financing eligibility is a separate approval decision made by the surety.

The Bail Process on a Robbery

From arrest to release, here's exactly what happens when you call Midnight Bail Bonds about a robbery.

1

Step 1: Arrest & Booking

The defendant is booked and bail is set from the county bail schedule by degree under Penal Code §212.5, plus any firearm or strike enhancement pleaded in the complaint.

2

Step 2: Call Midnight Bail Bonds

Call (909) 643-8359 with the defendant's full legal name, date of birth, and the arresting agency or jail. We locate them immediately and confirm the counts and bail amount.

3

Step 3: Qualification & Approval

We confirm the degree filed, check for firearm and strike enhancements, and evaluate cosigner credit and collateral. On six-figure bail we'll tell you exactly what security is required before you leave the house.

4

Step 4: Bond Posted at the Jail

Once paperwork is signed and the down payment is received, a licensed Midnight agent posts the bond at the facility holding the defendant. Release processing typically takes 2–8 hours depending on the county.
